The website All in Wood, accessible at all-in-wood.com (hereinafter referred to as the “Website”), is operated by:

Lucile Marin – Sole Proprietorship (Entreprise Individuelle)

All in Wood is the international brand/storefront operated by Lucile Marin.

ARTICLE 2 – SCOPE AND ACCEPTANCE OF THESE TERMS

These Terms and Conditions of Sale (hereinafter the “Terms”) apply to online sales of products offered by the Seller through the Website.

The Terms are available to customers at all times on the Website and may be saved or printed.

Before placing an order, the Customer is required to read and accept these Terms.

By checking the relevant box and confirming an order, the Customer acknowledges that they have read, understood and accepted the Terms applicable on the date of the order.

The confirmation of an order constitutes a binding contract between the Customer and the Seller.

ARTICLE 3 – PRODUCTS

All in Wood offers jewelry and accessories, including wooden rings, bracelets, necklaces and other jewelry made from or incorporating materials such as wood, stainless steel, tungsten, silver, resin and other materials.

Each Product is accompanied by a description presenting its main characteristics.

The Customer is responsible for reading the Product description before placing an order.

Product photographs are intended to provide the most accurate representation possible. However, photographs, colors and visual representations are provided for illustrative purposes and are not contractually binding.

Natural materials

The Customer expressly acknowledges that wood is a natural material.

Variations in grain, color, texture, pattern, shade, knots and other natural characteristics may therefore occur from one Product to another.

These natural variations make each piece unique and shall not, in themselves, be considered a defect or lack of conformity.

The appearance of the Product received may therefore differ slightly from the photographs displayed on the Website.

ARTICLE 4 – ORDERS

Products are offered subject to availability.

To place an order, the Customer selects the desired Products, any available options, quantities, sizes and personalization choices and adds them to the shopping cart.

Before confirming the order, the Customer has the opportunity to review:

  • the Products ordered;
  • quantities;
  • selected sizes and options;
  • personalization, where applicable;
  • prices;
  • delivery address;
  • delivery method;
  • shipping costs;
  • and the total amount payable.

The Customer is responsible for verifying this information before completing payment.

Once payment has been confirmed, the Customer receives an order confirmation by email.

The Seller reserves the right to refuse or cancel an order for legitimate reasons, including suspected fraud, payment problems, previous unpaid orders, obvious pricing errors or abnormal orders.

Product availability

If a Product becomes unavailable after an order has been placed, the Seller will inform the Customer as soon as reasonably possible.

Depending on the circumstances, the Customer may be offered:

  • an equivalent Product;
  • another available Product;
  • or a refund of the unavailable Product.

Personalized Products

Some Products may be personalized, including through engraving, custom dimensions, specific materials or other modifications requested by the Customer.

Once the production or personalization of such a Product has begun, modification or cancellation may no longer be possible.

ARTICLE 5 – PRICES, TAXES AND CUSTOMS DUTIES

Product prices are displayed on the Website in the currency selected or displayed at the time of purchase.

The final amount payable is displayed before the Customer confirms the order.

Shipping costs, where applicable, are displayed separately before payment.

Orders within the European Union

Applicable VAT is handled in accordance with the tax rules applicable to the transaction.

Orders outside the European Union

For deliveries outside the European Union, the Customer may be required to pay:

  • import VAT;
  • customs duties;
  • customs clearance fees;
  • local taxes;
  • or other charges imposed by the destination country.

Unless expressly stated otherwise during checkout, these charges are not included in the price paid to All in Wood.

They are determined by the authorities and/or carriers of the destination country and remain the responsibility of the Customer.

All in Wood has no control over these charges and cannot guarantee their amount.

The Customer is responsible for checking the import rules applicable in their country before placing an order.

ARTICLE 6 – PAYMENT

Orders must be paid in full when placed.

The Website accepts the payment methods displayed during checkout, including, where available:

Credit/debit card via Stripe

and

PayPal.

Payment transactions are processed through secure payment service providers.

All in Wood does not directly store the Customer’s full bank card details.

An order is considered valid once payment has been authorized by the relevant payment provider.

If payment is refused or cancelled, the order may automatically be cancelled.

The Seller reserves the right to carry out appropriate checks in the event of suspected fraudulent or abnormal transactions.

ARTICLE 7 – FORMATION OF THE CONTRACT

The Customer may review and correct their order before final confirmation.

The sales contract is concluded when the Customer confirms the order and the payment is successfully accepted.

An electronic order confirmation is then sent to the email address provided by the Customer.

The Customer is advised to retain the order confirmation and invoice as proof of the transaction.

Electronic records kept by the Seller and its payment providers may be used as evidence of transactions, subject to applicable law.

ARTICLE 8 – SHIPPING AND DELIVERY

All in Wood ships to the countries and destinations available during checkout.

The availability of delivery to a particular country may change at any time.

Shipping costs are displayed before the Customer confirms the order.

Preparation times

Products may have different preparation times depending on their availability, manufacturing requirements and personalization.

The estimated preparation or shipping time applicable to a Product is indicated on the Website or Product page where relevant.

Personalized, engraved or made-to-order Products may require additional preparation time.

Delivery times

Delivery times depend on:

  • the destination country;
  • the selected carrier;
  • the shipping method;
  • customs procedures;
  • and any circumstances beyond the Seller’s reasonable control.

Any estimated delivery time displayed on the Website is an estimate unless expressly stated otherwise.

For international shipments, customs clearance may cause additional delays for which All in Wood cannot be held responsible.

Delivery address

Products are delivered to the address entered by the Customer when placing the order.

The Customer is responsible for ensuring that the delivery address is complete and accurate.

Additional shipping costs resulting from an incorrect or incomplete address provided by the Customer may be charged to the Customer where permitted by applicable law.

Lost or damaged parcels

The Customer should inspect the parcel upon delivery whenever reasonably possible.

If the parcel appears visibly damaged, the Customer should report the damage to the carrier and contact All in Wood as soon as possible.

The Customer is encouraged to provide photographs of the parcel and Product where this may assist in processing the claim.

Nothing in this provision limits the Customer’s statutory consumer rights.

ARTICLE 9 – RIGHT OF WITHDRAWAL AND 30-DAY RETURN POLICY

9.1 Statutory right of withdrawal

Where the Customer qualifies as a consumer and has a statutory right of withdrawal under applicable law, the Customer may exercise that right within the legally applicable period.

For consumers covered by European Union consumer legislation, this period is generally 14 days from receipt of the goods, subject to statutory exceptions.

9.2 All in Wood 30-day return policy

In addition to applicable statutory rights, All in Wood offers Customers a commercial return period of 30 days from receipt of the order for eligible Products.

This commercial policy does not reduce or replace any mandatory rights granted to the Customer by applicable consumer law.

Return conditions

To qualify for a return, Products must be returned:

  • in their original condition;
  • complete;
  • with their accessories, where applicable;
  • without signs of abnormal use;
  • and in a condition allowing the Product to be resold.

The Customer should contact All in Wood before returning a Product in order to receive return instructions.

Returns must be sent to:

Lucile Marin – All in Wood
325 rue de la Chapelle
62370 Audruicq
France

Unless the return results from a lack of conformity or another situation where the Seller is legally responsible for return costs, return shipping costs are borne by the Customer.

The Customer is responsible for choosing an appropriate return shipping method and is advised to retain proof of shipment.

9.3 Personalized and custom-made Products

The right of withdrawal does not apply where an applicable statutory exception applies to Products made to the Customer’s specifications or clearly personalized.

This may include, depending on the Product:

  • engraved jewelry;
  • jewelry manufactured specifically to the Customer’s instructions;
  • custom designs;
  • special dimensions not normally offered;
  • or other clearly personalized Products.

Where such an exception applies, personalized Products cannot be returned simply because the Customer has changed their mind.

This does not affect the Customer’s rights where the Product is defective or does not conform to the order.

9.4 Refunds

Where a return is accepted, the refund will be made using the original payment method unless otherwise agreed.

Refunds will be processed within the time limits required by applicable law.

The Seller may withhold reimbursement until the returned goods have been received or the Customer has supplied evidence of having sent them back, where permitted by applicable law.

The Customer may be responsible for any reduction in the value of the Product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.

ARTICLE 10 – LEGAL GUARANTEES AND LIABILITY

Products sold by All in Wood benefit from the mandatory legal guarantees applicable to the sale.

For consumers covered by French and/or European consumer protection legislation, this may notably include the legal guarantee of conformity and the legal guarantee against hidden defects, under the conditions provided by applicable law.

Nothing in these Terms excludes or limits any mandatory consumer right that cannot legally be excluded.

Normal wear and use

The Seller cannot be held responsible for damage resulting from:

  • improper use;
  • failure to follow care instructions;
  • impacts or accidental damage;
  • exposure to conditions unsuitable for the Product;
  • modifications made by the Customer or a third party;
  • or normal wear and tear.

Jewelry should be used and maintained in accordance with any care instructions provided on the Website or with the Product.

Natural changes in wood caused by normal ageing or use do not necessarily constitute a defect.

Allergies and reactions

Information concerning Product materials is provided in Product descriptions where applicable.

Customers with known sensitivities or allergies are responsible for checking the composition of Products before purchase.

This provision does not exclude any liability that cannot legally be excluded under applicable consumer law.

Force majeure

The Seller shall not be liable for failure or delay in performing its obligations where such failure results from an event beyond its reasonable control, subject to applicable law.

ARTICLE 11 – AFTER-SALES SERVICE AND COMPLAINTS

For any issue concerning an order, Product, delivery or warranty claim, the Customer should contact All in Wood through the contact details provided on the Website.

The Customer should provide, where applicable:

  • their name;
  • order number;
  • description of the issue;
  • and photographs or other information useful for assessing the claim.

Products returned as part of an after-sales service claim must only be returned after contacting All in Wood and receiving the appropriate return instructions.

Where the Product is covered by a mandatory legal guarantee and the Seller is responsible for the return costs, reasonable return costs will be borne or reimbursed by the Seller in accordance with applicable law.

ARTICLE 12 – INTELLECTUAL PROPERTY

All content displayed on the All in Wood Website, including but not limited to:

  • texts;
  • photographs;
  • Product photographs;
  • designs;
  • graphics;
  • logos;
  • trademarks;
  • videos;
  • illustrations;
  • and Website content,

is protected by applicable intellectual property laws.

Unless prior written authorization has been obtained, reproduction, distribution, modification or commercial use of such content is prohibited.

ARTICLE 13 – PERSONAL DATA

Personal data collected through the Website is processed in accordance with the applicable privacy and data protection legislation, including the General Data Protection Regulation (GDPR) where applicable.

Further information concerning the collection, processing, storage and rights relating to personal data is available in the Website’s Privacy Policy.

ARTICLE 14 – GENERAL PROVISIONS

If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by the Seller to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision at a later date.

The Seller may modify these Terms from time to time.

The Terms applicable to an order are those in force on the date on which the Customer places the order.

Customers are therefore encouraged to save or print a copy of the Terms applicable at the time of purchase.

ARTICLE 15 – COMPLAINTS AND CONSUMER MEDIATION

In the event of a complaint or dispute, the Customer should first contact All in Wood in an attempt to reach an amicable solution.

As the Seller is established in France, eligible consumers may have access to the consumer mediation mechanism designated by the Seller, in accordance with applicable French consumer law.

The designated consumer mediator is:

MÉDIATION CONSOMMATION DÉVELOPPEMENT / MED CONSO DEV
Centre d’Affaires Stéphanois SAS
IMMEUBLE L’HORIZON – ESPLANADE DE FRANCE
3 rue J. Constant Milleret
42000 Saint-Étienne
France

Access to mediation is subject to the mediator’s eligibility and procedural requirements.

The Customer’s right to seek mediation or another form of alternative dispute resolution does not prevent either party from exercising any right to bring proceedings before a competent court.

ARTICLE 16 – APPLICABLE LAW AND JURISDICTION

These Terms and the contracts concluded through the Website are governed by French law.

However, where the Customer is a consumer residing in another country, this choice of law does not deprive the Customer of any mandatory consumer protection provisions applicable to them under the law that cannot be contractually excluded.

Any dispute should first, where possible, be submitted to All in Wood in an attempt to reach an amicable solution.

If no amicable solution can be reached, jurisdiction shall be determined in accordance with the mandatory rules applicable to the dispute.

Nothing in these Terms limits any right a consumer may have to bring proceedings before a court having jurisdiction under applicable consumer protection rules.

ARTICLE 17 – ACCEPTANCE OF THE TERMS

By placing an order on the Website, the Customer acknowledges that they have had the opportunity to read these Terms before completing the purchase.

By confirming the order and accepting the Terms during checkout, the Customer agrees to be bound by the version of the Terms applicable on the date of the order.

A copy of the applicable Terms may be provided to the Customer upon request.
